[ARCHIVED] Residents Reminded of Updates to City Fireworks Ordinance

May 17, 2019  The City of Midland reminds residents of recent changes made to the City’s fireworks ordinance that mirror new fireworks laws set by the Michigan State Legislature in 2018.

As of April 22, 2019, Section 16-34 of the Code of Ordinances has been amended to allow for the use of consumer fireworks in the City of Midland only on the following days and times beginning at 11 a.m.:

  • December 31 until 1 a.m. on January 1;
  • The Saturday and Sunday immediately preceding Memorial Day until 11:45 p.m. on each of those days;
  • June 29 to July 4 until 11:45 p.m. on each of those days;
  • July 5, if that date is a Friday or Saturday, until 11:45 p.m.; and
  • The Saturday and Sunday immediately preceding Labor Day until 11:45 p.m. on each of those days

Section 16-34(a) defines consumer fireworks as “fireworks devices that are designed to produce visible or audible effects by combustion, that are required to comply with the construction, chemical composition, and labeling regulations promulgated by the United States consumer product safety commission under 16 CFR parts 1500 and 1507, and that are listed in APA standard 87-1, 3.1.2, 3.1.3, or 3.5.” This does not apply to low-impact fireworks, such as sparklers or other ground and handheld devices.                                                                                          

Residents are reminded that noise and litter ordinances remain in effect at all times and that consumer fireworks use is prohibited on any public or private property without permission, including City parks.

Violations of this ordinance are subject to a $1,000 fine per offense.
